Terms of Service

1. Introduction
These Terms of Service (“Terms”) govern your access to and use of the Tickts platform, operated by TICKTS LTD (Company No. 17029682), registered at 124-128 City Road, London, EC1V 2NX (“we”, “us”, “our”, “Tickts”). By using our website, mobile applications, or services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
Tickts acts as agent. When you purchase a Ticket through the Platform, the contract for the Event itself is between you and the Organiser of that Event. Tickts acts as a limited agent of the Organiser to facilitate the sale, payment processing (via the Organiser’s connected Stripe account), ticket delivery, and post-purchase customer service. Tickts is not the principal seller of the Ticket and is not the Event provider. Each Event listing identifies the Organiser; Organiser identity, contact details and any Event-specific terms are presented at point of sale.
2. Definitions
In these Terms, the following definitions apply:
- “Platform” means the Tickts website, mobile applications, scanner app, and all related services.
- “User” means any individual who accesses or uses the Platform, including Fans and Organisers.
- “Fan” means a User who purchases, holds, or uses tickets through the Platform.
- “Organiser” means a User who creates events and sells tickets through the Platform.
- “Event” means any event listed on the Platform by an Organiser.
- “Ticket” means a digital mobile ticket issued through the Platform for an Event, delivered via Apple Wallet and Google Wallet passes. A PDF version is also attached to the order confirmation email as a backup.
- “Sub-Event” means an individual date or occurrence within a multi-date Event.
3. User Accounts
To access certain features of the Platform, you must register for an account. You may register using an email address and password, or by signing in with a third-party provider (Google or Apple). When you sign in via a third-party provider, we receive your name and email address from that provider to create or link your account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
You are responsible for safeguarding the password or third-party authentication credentials that you use to access the Platform and for any activities or actions under your account. You agree not to disclose your credentials to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.
We reserve the right to suspend or terminate your account at our discretion if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if your account poses a risk to the Platform or other Users. We may also suspend accounts that have been inactive for an extended period. You may close your account at any time through your account settings. When you close your account, your personal information is anonymised. Transaction records are retained as required by law. Organisers are subject to additional closure restrictions , see Organiser Terms.
4. Ticket Purchases
When you purchase a Ticket through the Platform, you are entering into a contract directly with the Organiser of the Event. Tickts acts solely as an intermediary technology platform and is not a party to the contract between you and the Organiser. All Tickets are subject to availability and the Organiser’s own terms and conditions.
Tickts does not charge booking fees or service fees to Fans. Payment processing is handled by Stripe, which charges a processing fee of 1.5% + 20p per paid ticket. Organisers choose whether to absorb this fee into their ticket price or pass it on to the buyer. Where an Organiser passes it on, the processing fee is stated alongside the advertised ticket price on the Event page and itemised at checkout. In all cases the total shown to you at checkout before you pay is the final price with no hidden charges. Free events have zero fees.
Payments are processed securely through Stripe and paid directly to the Organiser’s connected Stripe account. Other than fan-to-fan resale transactions (see Section 6a), Tickts does not hold, receive, or control funds from ticket sales. Depending on your device and location, Stripe may also offer additional payment methods at checkout, such as Link, Klarna, or Clearpay. If you choose a buy-now-pay-later option, your credit agreement is with that provider and subject to its own terms, eligibility checks, and privacy notice; the Organiser is still paid in full through Stripe.
Pay by Bank. On some Events you may also be offered “Pay by Bank”, an open-banking payment method provided through Stripe that lets you pay directly from your bank account instead of by card. If you choose it, you are securely redirected to authorise the payment with your own bank, and the funds settle to the Organiser’s connected Stripe account in the same way as a card payment. The payment is still processed by Stripe and the Organiser remains the merchant of record. A Pay by Bank payment is a single one-off payment, not a credit agreement. Refunds of a Pay by Bank payment are made by the Organiser from their Stripe balance back to the account you paid from (see our Refund Policy). Because a bank-to-bank payment is not a card payment, the card chargeback route does not apply to it; if there is a problem, contact the Organiser or Tickts and, where relevant, your bank.
Organiser as merchant of record. The Organiser of each Event is the merchant of record for that Event. The Organiser receives the funds, is the counterparty to your purchase contract, and is responsible for delivering the Event, fulfilling the ticket, honouring its own refund policy, and resolving any complaint about the Event itself (including content, scheduling, line-up, venue, accessibility, and on-the-night experience). Tickts provides the technology that enables the sale and the ticket, and is not the seller of the ticket.
All Tickets are delivered as mobile tickets via Apple Wallet and Google Wallet passes, accessible from your device’s digital wallet. A PDF version of your Ticket is also attached to the order confirmation email as a backup. You are responsible for ensuring you can access your Tickets on your device at the Event. Tickts is not liable for device failures, connectivity issues, wallet-app bugs outside our control, or inability to display wallet passes at the venue. Where a wallet pass cannot be displayed, the PDF attached to your order confirmation email is a valid alternative.
Ticket dependencies. Some Organisers configure ticket dependencies (for example, a Child or Concession ticket may require an Adult ticket to be in the same order, at or above a minimum quantity). Where this applies, the requirement is shown next to the relevant ticket option, and checkout will not complete until the requirement is met.
Checkout questions. Some Organisers may add their own questions at checkout (for example, dietary requirements, T-shirt size, or marketing-consent opt-ins). Your answers are sent to the Organiser as the data controller for that event. Refer to the Organiser’s own privacy notice for how they will use that information.
Box-office and complimentary Tickets. Where you obtain a Ticket through an Organiser’s box office (for example, cash, a card payment taken in person, or a complimentary Ticket), the Ticket is still issued through the Platform. Where the in-person payment was taken by cash (or another method the Organiser handles off-Platform), no Stripe payment is processed, and any refund is issued by the Organiser through the channel the payment was originally made; you do not have card-chargeback rights against Tickts or Stripe for those payments. Complimentary Tickets are subject to the Organiser’s own conditions of issue.
In-person card payments (card reader and Tap to Pay). Some Organisers take card payments in person at the door or box office using a card reader, or by Tap to Pay on their own phone, through Stripe. A card payment taken this way is processed by Stripe and settles to the Organiser’s connected Stripe account in the same way as an online card payment. Any refund is made by the Organiser from their Stripe balance to the card used, and, because it is a card payment, the normal card-chargeback route is available to you.
Add-ons, merchandise, food and drink. Some Organisers offer optional extras alongside Tickets (for example a programme, a drink, merchandise, or food). Any add-ons you select are charged at the price shown, are included in your order total, and are supplied by the Organiser, not by Tickts. Where an add-on is a physical good to be delivered or posted to you rather than collected at the Event, the Organiser is responsible for delivery and for handling it in line with your consumer rights for goods bought at a distance (which, for physical goods, may include a 14-day right to cancel and return, unlike Tickets for dated Events). Digital, perishable, or on-the-day items (such as food, drink, or items consumed at the Event) may not carry that right. Add-ons are otherwise refundable on the same basis as the Tickets in your order, subject to your statutory rights.
Reserve and pay the Organiser directly. For some Events the Organiser may offer a “reserve now, pay the Organiser” option instead of online card payment. Where you use it, you reserve a place but no payment is taken through the Platform. You pay the Organiser directly by the method they specify, and your Ticket is issued once the Organiser confirms your payment. A reservation is held for a limited time and is released automatically if payment is not confirmed within that period. Because the payment is made directly to the Organiser, it does not pass through Stripe or Tickts, and you do not have chargeback rights against Tickts or Stripe for it.
4a. Donations
Some Organisers (or charities running an Event) may invite you to add an optional donation to your order. A donation is a voluntary gift to the Organiser or charity. It is separate from your Ticket, is not part of the ticket contract, and is paid directly to the Organiser or charity rather than for admission to the Event. You only pay a donation if you choose to add one, and the amount is itemised before you confirm.
Donations are generally non-refundable, including where your Ticket or the Event is refunded or cancelled, because the gift has already passed to the Organiser or charity. An Organiser may choose to refund a donation at their discretion.
Gift Aid. Where an Event is run by a charity recognised by HMRC and verified on the Platform, you may be offered the option to Gift Aid your donation. Gift Aid is a matter between you (the donor) and the charity. If you Gift Aid your donation you confirm that you are a UK taxpayer, you make a Gift Aid declaration, and you provide your home address so that the charity can claim Gift Aid from HMRC. The charity, not Tickts, makes and is responsible for the claim. If your donation is later refunded after Gift Aid has been claimed, the charity is responsible for adjusting the claim with HMRC. Tickts only facilitates the capture of your donation, declaration, and details, and is not the recipient of the donation or a party to the Gift Aid claim.
4b. Online Events
Some Events take place online rather than at a physical venue. For an online Event, your Ticket is a licence to join the Event remotely, and admission works by a joining link (for example a Zoom, Teams, Google Meet, or webinar link) rather than a QR code at a door.
Joining link delivery. Where the Organiser has provided the joining link, it is included in your order confirmation email. Where the Organiser has not yet provided it, your confirmation will say so, and the link will be sent to the email address on your order before the Event starts. Keeping a working joining link on file, and delivering a functioning online Event, is the Organiser’s responsibility.
If the link never arrives or does not work. If you do not receive a joining link before the Event starts, or the link provided does not admit you and the Organiser does not remedy it, the Event has not been supplied to you and you are entitled to a full refund of the ticket price from the Organiser, on the same basis as a cancelled Event under Section 5. Check your spam folder and contact the Organiser first; Tickts can assist in facilitating contact.
Cooling-off. Tickets for online Events are still tickets for a leisure activity on a specific date, so the cooling-off exemption described in Section 5 applies to them in the same way as to in-person Events. You are responsible for your own device, software, and internet connection meeting the requirements the Organiser specifies for joining.
4c. Split the Bill (group payments)
For some Events an Organiser may let one person start a “split the bill” group order, where the cost is divided into shares (one share per Ticket) and each member of the group pays their own share. The person who starts the split receives a link to share with the others; each participant follows a personal link and pays their own share by card (or another available method) through Stripe on the Organiser’s connected account. The Tickets are reserved while the group pays.
- Tickets issue only when the split is complete. The Tickets are issued once every share has been paid.
- If the split is not completed in time. If the deadline passes before all shares are paid, the split lapses: the shares already paid are refunded to the people who paid them, and the reserved inventory is released back for sale. No Tickets are issued for an incomplete split.
- Each participant pays only their own share. You are charged only for the share you pay; you are not responsible for another participant’s unpaid share. Each participant’s payment and refund are handled individually.
- Refunds after completion. Once the Tickets have issued, refunds and cancellations follow the ordinary rules in Section 5 and the Organiser’s refund policy, refunded to each participant’s original payment method.
4d. Call Dibs (reserving a place on a sold-out Event)
Where an Organiser has enabled it, if a Ticket type has sold out you may “call dibs” to join a priority list for that Event. When you call dibs you securely save a card using Stripe; no payment is taken at that point. The saved card is held by Stripe on the Organiser’s connected account, not by Tickts, and is used only for the purpose described below.
- When you are charged. You are charged only if a place later becomes available (for example, another buyer refunds or releases a Ticket, a resale place is listed, or a reservation lapses) and your dib is next in line. At that point your saved card is charged the Ticket price and your Ticket is issued automatically, and we email you to let you know.
- When you are not charged. If no place becomes available, your dib simply expires after 30 days, or sooner if the Event starts first, and your saved card is never charged. You can also cancel your dib at any time before it is fulfilled, and it will not be charged.
- Price limit. You are charged the Ticket price in effect for that Ticket type at the moment a place opens, up to any maximum price you set when you called dibs. If the price has risen above your maximum, your dib is not charged.
- Refunds. Once a dib has been fulfilled and your Ticket issued, it is an ordinary Ticket, and the refund rules in Section 5 and the Organiser’s refund policy apply to it.
4e. Make-it-happen Pledges
Some Organisers test demand for a proposed Event by inviting Fans to “pledge” towards a target before the Event is confirmed. When you pledge, you securely save a card using Stripe towards the Ticket you want; no payment is taken at that point, and the saved card is held by Stripe on the Organiser’s connected account, not by Tickts.
- If the Event goes ahead. If the target is met and the Organiser confirms the Event, your saved card is charged the pledged amount and your Ticket is issued. We email you when this happens.
- If it does not. If the target is not met by the deadline, or the Organiser cancels the campaign, your pledge is released and your saved card is never charged.
- Cancelling your pledge. You can cancel your pledge at any time before it is charged, and your saved card will not be charged.
- Refunds. Once a pledge has been charged and your Ticket issued, the refund rules in Section 5 and the Organiser’s refund policy apply.
5. Refunds & Cancellations
Refund policies are set by individual Organisers. If an Event is cancelled by the Organiser, you are entitled to a full refund of the ticket price. Tickts will facilitate the refund process through Stripe, but the Organiser is ultimately responsible for issuing refunds.
If you wish to request a refund for any other reason, you must contact the Organiser directly. Tickts may assist in facilitating communication between Fans and Organisers but is not obligated to issue refunds on behalf of Organisers.
Refunds come from the Organiser’s funds. Because payments for an Event are paid directly to the Organiser’s connected Stripe account, refunds are issued from that Organiser’s available balance. Tickts does not hold ticket-sale funds and does not refund ticket-sale funds out of its own resources. Where an Organiser’s connected Stripe account has insufficient balance, has been suspended, has been closed, or is otherwise unable to process a refund, your remedy is against the Organiser, not against Tickts. Where a debit or credit card was used and the Organiser does not refund you, you may be able to raise a chargeback with your card issuer; nothing in these Terms restricts your statutory rights to do so.
Tickets are for leisure events on specific dates. They therefore fall within the cancellation-right exemption at section 111(j) of the Consumer Rights Act 2022 (Ireland), which excludes the standard 14-day cooling-off period for "the supply of services related to leisure activities, if the contract provides for a specific date or period of performance". The 14-day right of withdrawal that applies to most distance contracts under Part 5 of the Consumer Rights Act 2022 does not apply to ticket purchases made through the Platform.
Nothing in these Terms affects your non-excludable statutory rights as a consumer under the Consumer Rights Act 2022, the Sale of Goods Act 1893, the Sale of Goods and Supply of Services Act 1980, the Consumer Protection Act 2007, or any other applicable Irish consumer protection legislation.
5a. Optional Refund Protection
At checkout, you may opt in to an optional Refund Promise product offered by TicketPlan, an independent third-party provider. If you opt in, we share your name, email address, and ticket and event details with TicketPlan so that they can issue and administer the policy. Eligibility, claim handling, and any refund issued under the Refund Promise are the sole responsibility of TicketPlan. The cost is shown separately at checkout and is non-refundable once the order is placed.
TicketPlan’s own terms and privacy notice are linked from the checkout page; please read them before opting in. Tickts is not the seller, administrator, or guarantor of the Refund Promise product. Any claim, complaint, or dispute about the Refund Promise must be raised with TicketPlan directly, in accordance with their published terms.
6. Ticket Transfers
Where enabled by the Organiser, you may transfer Tickets to another person through the Platform’s transfer feature, free of charge. Transferred Tickets are subject to the same terms and conditions as the original purchase. You may not sell or resell Tickets above their face value through the Platform. Resale at or below face value, where the Organiser has enabled it, is handled through the Platform’s resale feature described in Section 6a.
6a. Ticket Resale
Where the Organiser has enabled resale for an Event, and once the relevant Ticket type for that Event has sold out, Fans who can no longer attend may list their Ticket for resale to other Fans through the Platform’s official resale feature. Resale is a fan-to-fan facility: the Organiser is not the seller, and the Organiser receives no part of the resale price or any resale fee.
- Capped at face value. Tickets may only be resold at, or below, their original face value. Listing above face value is not possible on the Platform, and the face value of every Ticket is shown at the point of resale.
- No booking fee for buyers. If you buy a resale Ticket, you pay the listed price and nothing more. There is no booking fee on either side of a resale.
- Verified transfer. When a resale completes, the seller’s original Ticket and QR code stop working and a new, valid Ticket and QR code are issued to the buyer. Only one valid Ticket ever exists for each resold place.
- Who may sell. To list a Ticket for resale you must own a valid Ticket, have a verified email address, and have connected and completed onboarding for a Stripe Express payout account through which your funds are paid. Season-pass Tickets cannot be resold, and Organisers cannot list their own Tickets for resale.
- Resale service fee. When a resale Ticket sells, Tickts retains a service fee from the seller of 5% of the resale price, subject to a minimum of 50p per Ticket, to cover the secure transfer and payment handling. The buyer pays no fee and the Organiser receives nothing.
- Seller payout. Resale payments are collected by Tickts (via Stripe) rather than by the Organiser. The seller’s proceeds (the resale price less the service fee) are held by Tickts and paid to the seller’s Stripe Express account approximately five working days after the Event has taken place. This is one of the limited situations in which Tickts briefly holds transaction funds, and the delay protects buyers in the event of a problem with the Event or a payment dispute.
- Refunds, disputes and cancelled Events. If the Event is cancelled, the resale buyer is refunded and the seller is not paid. If a resale payment is refunded or formally disputed, the seller’s payout is withheld pending resolution. If a listing is no longer available at the moment of purchase, the buyer is automatically refunded in full.
Ireland. The Sale of Tickets (Cultural, Entertainment, Recreational and Sporting Events) Act 2021 prohibits the resale of tickets above their original sale price for designated events and venues. Because the Platform caps all resale at, or below, face value, resale through the Platform is consistent with that Act.
6b. Gift Cards
Some Organisers offer gift cards through the Platform. A gift card is a prepaid credit issued by, and redeemable only with, the specific Organiser named on it: it is not a Tickts-wide credit and cannot be used with other Organisers. When you buy a gift card, your payment goes directly to that Organiser’s connected Stripe account in the same way as a ticket purchase, and the Organiser is responsible for honouring the balance.
- Expiry. If a gift card has an expiry date, it is shown prominently before you buy and on the gift card itself. Any remaining balance is lost on expiry.
- Redemption. The balance can be spent, in one or more orders, on that Organiser’s Events through the Platform. Where an order costs more than the remaining balance, you pay the difference; where it costs less, the remainder stays on the card.
- No cash out. Gift cards and remaining balances cannot be exchanged for cash, except where a refund is required by law.
- Refunds. Gift cards are non-refundable once delivered, except where required by law. Where an order paid with a gift card is refunded, the refund is returned as gift-card balance.
- Organiser failure. Because the prepaid funds are held by the Organiser and not by Tickts, if the Organiser ceases trading or leaves the Platform your remedy in respect of an unspent balance is against the Organiser.
7. Payment Plans & Season Passes
Where available, Organisers may offer payment plans allowing you to pay for Tickets in instalments. Payment plans are only available for Events that are at least 30 days away. By entering into a payment plan, you agree to the following terms:
- Deposit: An initial deposit (set by the Organiser, typically 25% of the total price) is charged at checkout. The deposit is non-refundable unless the Event is cancelled by the Organiser.
- Instalments: The remaining balance is split into equal instalments (typically 3), charged automatically to the payment method you provided at checkout. All instalments are scheduled to complete at least 7 days before the Event date.
- Off-session charges: By entering into a payment plan, you authorise Tickts to charge your saved payment method on the scheduled dates without requiring you to be present on the Platform. You are responsible for ensuring your payment method remains valid and has sufficient funds.
- Ticket status: Your Tickets are issued immediately but held in a “pending payment” status until all instalments are paid. Pending Tickets are valid for entry to the Event, but may be cancelled if payment fails.
- Failed payments: If an instalment payment fails, we will retry up to 3 times. If all 3 attempts fail, your payment plan will be cancelled, your Tickets will be revoked, and the reserved inventory will be released for sale to other buyers. The deposit is not refunded, but any instalments you have already paid beyond the deposit are refunded to your original payment method.
- Event cancellation: If the Event or Sub-Event is cancelled by the Organiser while your payment plan is active, the plan will be cancelled and no further instalments will be collected. Refund of payments already made is subject to the Organiser’s refund policy.
Season passes, where offered, are subject to the specific terms set by the Organiser. Season passes may not be transferable unless the Organiser explicitly permits it.
7a. Memberships
Some Organisers offer memberships: a recurring subscription to that Organiser, paid automatically at the interval shown when you join (for example monthly or annually), which may unlock member pricing, early access, or other benefits the Organiser sets. By joining a membership you authorise recurring charges to your saved payment method, collected via Stripe and paid to the Organiser’s connected Stripe account, until you cancel.
- Renewal reminders. We email you before each renewal, telling you the renewal date and amount and how to cancel.
- Cancelling. You can cancel at any time from your account. Cancellation takes effect at the end of the period you have already paid for; you keep your benefits until then, and no further charges are taken. Amounts already charged for the current period are not refunded unless the Organiser’s own terms say otherwise or the law requires it.
- Price changes. If the Organiser changes the membership price, the new price applies only from your next renewal, and you will be told before it takes effect.
- Organiser benefits. The membership benefits are provided by the Organiser, not by Tickts. If the Organiser withdraws the membership programme or leaves the Platform, no further charges are taken; any remedy for the remainder of a period you have paid for is against the Organiser.
8. Organiser Terms
If you register as an Organiser, you agree to additional terms governing your use of the Platform to create and manage Events. These are set out in our Organiser Terms.
Organisers are responsible for ensuring that their Events comply with all applicable laws and regulations, including but not limited to licensing requirements, health and safety regulations, and consumer protection laws.
9. Intellectual Property
The Platform and its original content, features, and functionality are owned by TICKTS LTD and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Platform, except as permitted by these Terms.
By uploading content to the Platform (including event images, descriptions, and logos), you grant Tickts a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content solely for the purpose of operating and promoting the Platform and your Events. You retain all ownership rights in your content.
By submitting reviews, ratings, testimonials, feedback, or similar content about the Platform (whether directly to Tickts or on third-party review platforms such as Trustpilot), you grant Tickts a perpetual, worldwide, royalty-free licence to quote, display, reproduce, and republish that content for marketing and promotional purposes across our website, email campaigns, social channels, and advertising. You retain ownership of your words, and we will attribute reviews to their author where displayed. If you wish to withdraw consent for the display of a review you have submitted, contact us at [email protected] and we will remove it from our own channels within a reasonable period.
AI and machine learning. We do not train external generative AI models on your personal data, your account contents, your buyer records, or content you upload. We may use aggregated, anonymised, or de-identified usage data to improve the Platform, including internal quality, reliability, fraud-detection, and product-development models. We do not authorise any third party to scrape the Platform or use its content to train AI models, and any such use is expressly prohibited under Section 10 (Prohibited Conduct).
10. Prohibited Conduct
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable law;
- Attempt to gain unauthorised access to any part of the Platform, other accounts, or computer systems;
- Use automated scripts, bots, or scrapers to access the Platform or collect data;
- Interfere with or disrupt the integrity or performance of the Platform;
- Impersonate any person or entity, or falsely state or misrepresent your affiliation;
- Purchase Tickets for the purpose of reselling above face value;
- Use the Platform to distribute spam, malware, or other harmful content;
- Circumvent any security features or access controls of the Platform.
11. Platform Availability
The Platform is provided on an “as is” and “as available” basis without any warranty or guarantee of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Platform will be uninterrupted, error-free, secure, or free from viruses or other harmful components. We may perform scheduled maintenance, updates, or improvements that temporarily affect availability. We rely on third-party services (including Stripe for payments, email delivery providers, and cloud infrastructure) and cannot guarantee the continued availability or performance of those services.
12. Limitation of Liability
To the maximum extent permitted by applicable law, TICKTS LTD shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of, or inability to access or use, the Platform;
- Any conduct or content of any third party on the Platform, including Organisers;
- Any content obtained from the Platform;
- Unauthorised access, use, or alteration of your transmissions or content;
- Failure of QR code scanning, ticket validation, or entry systems at events;
- Delays or failures in ticket transfers between users;
- Payment processing errors, delays, or failures by Stripe or other payment providers;
- Failure to deliver or display digital wallet passes (Apple Wallet, Google Wallet);
- Errors in promo code application, payment plan processing, or waitlist notifications;
- Any event cancellation, postponement, venue change, or failure to deliver the advertised experience.
Tickts does not charge booking fees to Fans, or commission on an Organiser’s primary ticket sales. The only per-transaction amounts Tickts retains are the resale service fee described in Section 6a and, where an Organiser runs an optional promoter or rep programme, the promoter/rep commission described in the Organiser Terms. All payment processing fees are charged by Stripe, not by Tickts. Optional paid subscription plans are available for Organisers seeking advanced features (see Section 17 below). Accordingly, our total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed one hundred pounds sterling (£100).
Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by English law.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: natural disasters, acts of God, war, terrorism, civil unrest, government action or regulation, pandemic, epidemic, power failure, internet or telecommunications failure, failure of third-party services (including payment processors, email providers, and hosting infrastructure), cyberattacks, and labour disputes.
14. Indemnification
You agree to indemnify, defend, and hold harmless TICKTS LTD, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of another party; or (d) any content you upload or submit to the Platform.
14a. Online Marketplace Information
Where the Platform displays Events from multiple Organisers in a list, search results or category page, the default ordering is by Event start date (soonest first). Where a different ordering applies (for example, ordering by relevance for a search query, by ticket price, or by popularity within the preceding 30 days), the active ordering is displayed in the page controls. Tickts does not currently accept payment from Organisers in exchange for higher ranking. If paid placements are introduced in future, they will be marked clearly as “Promoted” or “Featured” on the listing.
Organisers listed on the Platform may be either a trader (a business or natural person acting in a commercial, business, craft or professional capacity) or a non-trader (e.g. a charity or community group). The Organiser’s status is identified on each Event listing where it has been declared during onboarding. Statutory consumer-protection rights against the Organiser apply only where the Organiser is a trader.
15. Dispute Resolution
For Irish consumers using tickts.ie, these Terms shall be governed by and construed in accordance with the laws of the Republic of Ireland. Any disputes arising out of or in connection with these Terms involving an Irish consumer shall be subject to the non-exclusive jurisdiction of the courts of Ireland, without prejudice to a consumer's right to bring proceedings in their place of habitual residence as preserved by Article 18 of Regulation (EU) 1215/2012.
Before initiating formal legal proceedings, you agree to first contact us at [email protected] to attempt to resolve the dispute informally. We will endeavour to respond to and resolve complaints within 14 days.
Out-of-court redress for Irish consumers. If we cannot resolve your complaint within a reasonable period, you have the right to refer the matter to the Competition and Consumer Protection Commission (CCPC) at ccpc.ie or by phone at 01 402 5500. You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr to submit a complaint about an online purchase. The use of either route does not affect any other statutory remedy available to you.
16. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect, by email to the address associated with your account or by prominent notice on the Platform. What constitutes a material change will be determined at our sole discretion.
By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new Terms, please stop using the Platform.
17. Subscription Plans
Tickts offers optional paid subscription plans (“Growth” and “Pro”) that provide Organisers with access to advanced features beyond those included in the free Starter plan. The Starter plan is available to all Users at no cost and does not require a subscription.
Subscriptions are billed monthly via Stripe. By subscribing to a paid plan, you authorise Tickts to charge your chosen payment method on a recurring monthly basis until you cancel. You may cancel your subscription at any time through your account settings. Upon cancellation, your subscription features will remain active until the end of your current billing period, after which your account will revert to the free Starter plan.
Tickts reserves the right to change subscription pricing at any time. We will provide at least 30 days’ notice of any pricing changes by email to the address associated with your account. If you do not agree to the new pricing, you may cancel your subscription before the change takes effect.
Subscriptions are non-refundable for partial billing periods. If you cancel mid-period, you will not receive a pro-rata refund, but you will retain full access to your subscription features until the end of that billing period. Nothing in this section affects your statutory rights under the Consumer Rights Act 2015 or any other applicable consumer protection legislation.
18. General
Entire agreement. These Terms, together with our Privacy Policy, Cookie Policy, and (for Organisers) the Organiser Terms, constitute the entire agreement between you and Tickts in respect of your use of the Platform and supersede any prior agreements, understandings, or representations on the same subject.
Severability. If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be severed and the remaining provisions shall continue in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. A waiver of any breach is not a waiver of any subsequent breach.
Assignment. You may not assign or transfer these Terms or any of your rights or obligations under them without our prior written consent. We may assign or novate these Terms to any successor in connection with a merger, acquisition, restructuring, or sale of the business, on the same terms.
Notices. Notices to you may be given by email to the address associated with your account, by message in your account, or by prominent notice on the Platform. Notices to us must be sent to [email protected], with formal legal notices also sent to TICKTS LTD, 124-128 City Road, London, EC1V 2NX.
Electronic communications. By using the Platform, you consent to receiving communications from us electronically, including by email and through your account. Electronic communications satisfy any legal requirement that a communication be in writing.
Third-party rights. A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term, except that Stripe may enforce any term that expressly references Stripe.
Headings. Section headings are for convenience only and do not affect the interpretation of these Terms.
Statutory rights preserved. Nothing in these Terms excludes, restricts, or modifies your non-excludable statutory rights as a consumer under the Sale of Goods Act 1893, the Sale of Goods and Supply of Services Act 1980, the Consumer Protection Act 2007, the Consumer Rights Act 2022, or any other applicable Irish consumer protection legislation.
